Rental Agreement

TERMS AND CONDITIONS 

This agreement is between Southern Coast (Company) and (Renter). By booking your rental of the Property with Southern Coast, you acknowledge that you have read and understand, and agree to be bound by, all terms, conditions, and policies in this Agreement, including any Unit-Specific Terms 

ADVANCE BOOKING AGREEMENT 

- Fifty percent (50%) of the total booking charges are due at the time the reservation is made, fully refundable if you cancel 30 days prior to check-in.

- Remaining balance is due in full 30 days prior to check-in and is Non-Refundable.

- If you book within 30 days of your arrival date, the total amount is due upon booking and is Non-Refundable.

- If balance is not paid in full 30 days prior to arrival management reserves the right to cancel the reservation. If cancelled, NO Refund will be issued. 

ADULT ONLY RENTAL 

The Property will not be rented to individuals under the age of 25 (age of 21 for guests staying at Top of the Gulf Resort), unless accompanied by an adult guardian or parent who remains on the Property for the duration of the stay. The minimum age varies by Resort and is strictly enforced, please refer to unit info or reach out to us to confirm if you do not meet the minimum age of 25. You agree to be solely responsible for your actions and the actions of all family members and guests present at the Property at any time during your stay, and to ensure that all Occupants understand and comply with the Terms. Reservations made under false pretenses will be subject to forfeiture of all monies paid. 

MAXIMUM OCCUPANCY 

The number of occupants is clearly stated at the time of booking and includes all adults and children. If additional people are found in Property, it could be deemed a violation and Renter may be subject to immediate eviction. Additionally, any activity constituting a nuisance of which is offensive or disruptive to other guests in the community, resort, and/or complex, or illegal activities, are prohibited and may subject you to eviction and forfeiture of all monies paid, including rent, fees, and deposits. 

DAMAGE WAIVER

The Golden Rule - You Break It You Buy It. You are responsible for ALL damages during your stay - if you arrive and find damage, please let us know upon check-in. A Damage Waiver Fee is charged which gives you accidental damage coverage up to $500 but does not cover any violations to the rental agreement. You are responsible for all damages over the defined amount. 

CHECK-IN

Check-in begins at 4pm Central Time (CST). Please do not show up early, as it often causes issues with cleaners and maintenance personnel.

Five days prior to the arrival date, a welcome letter will be sent to the email address that we have on file. This letter will provide Guest(s) with check-in information including the door code. This is system generated and comes from 'noreply@escapia.com." If you do not receive it in your inbox, check your junk/spam folder or reach out to us before you travel to our area.

During our peak season, or on days we have a check-out and check-in, no early check-ins will be permitted.

Unauthorized early arrivals will be subject to a fee of $150.

Guests are Not Authorized to park vehicles in the driveway or on Property until check-in (4:00 PM CST). 

CHECK-OUT 

Check-out is no later than 10am Central Time (CST). There will be a $150 late check-out fee assessed every 30 minutes after 10am.

A Southern Coast member will check the property no earlier than 10am CST to perform a damage inspection.

Check-out procedures:

- Remove all trash from the unit and place in the trash chutes located on each floor. 

- Load dishwasher with any dirty dishes and run through clean cycle with detergent. 

RULES AND REGULATIONS 

All rental and deposit monies will be forfeited, and the Renter will be asked to vacate the Property immediately and or incur extra charges, for a breach of this Agreement, which includes but is not limited to failure to follow the rules below: 

1. Absolutely NO SMOKING of any kind in the Property or from the decks or balconies. If during your stay it is found that you are smoking or have smoked inside the unit, this violation will result in immediate eviction and forfeiture of all rental payments and a minimum fee of $500. If signs of smoking are found on property after departure, Management will charge the credit card on file a minimum fee of $500. 

2. Pets are NOT ALLOWED. Unauthorized occupancy of pets will result in immediate eviction and a $500 non-authorized pet fee per pet will be charged to the credit card on file. 

3. Large parties or excessive noise are not allowed. Noise audible outside the Property is prohibited between 10 p.m. and 8 a.m. 

4. The number of people staying on the Property may not exceed designated amount. 

5. Do not have or use fireworks, firecrackers on the Property or on the site. 

6. No furnishings or equipment from the Property may be taken out of the property or off site. 

7. No furnishings, equipment, any other items, or any other element of the property will be damaged. 

8. Do not leave windows and doors open while the air conditioning is on, as this may cause the HVAC units to freeze up and not work properly. 

9. All applicable laws as well as association rules and covenants must be observed. 

10. Renter may not assign or sublease all or part of this Agreement and Property. 

11. Please treat the Property with the same care you would use with your own residence and leave it in the same condition it was in when you arrived. To prevent theft of or damage to furnishings or your personal property, you agree to close and lock doors and windows when you are not present at the Property and upon check-out. 

SERVICE AND MAINTENANCE CALLS 

You are staying in a privately owned condominium and as such, maintenance issues can arise. While we apologize for any inconvenience of a mechanical failure or utility outage, we will not be able to offer a discount or refund. However, if an issue is reported and maintenance determines the issue is the fault of the renter, renter may be held liable for the cost of repair, service, parts and/or labor. While issues are unfortunate, they are a reality when dealing with any form of real estate. We monitor our dedicated maintenance line 24/7, however during periods of high occupancy, there can be delays in getting someone to the property or getting a confirmation return call. We must schedule maintenance calls based on the level of severity of each issue. We work tirelessly to ensure everyone is taken care of, however below are some guidelines to help make your stay more enjoyable. 

1. Air Conditioner: Do not leave doors and/or windows open while running the a/c as it is a frequent cause of freezing up the a/c unit. This will cause the a/c unit to not cool and will require a service call. If our team determines the a/c unit froze up because of this, you will be liable for the cost. 

2. Housekeeping Issues: Any housekeeping issues must be reported by 10am Central Time (CST) the day following the date of arrival. Company cannot be responsible for housekeeping issues found after this time. No refunds will be made on cleaning fees, you must contact us upon arrival in the event there is an issue so that we can send the appropriate team members to rectify the problems. 

LINENS/TOWELS/SUPPLIES 

Although linens are furnished, please bring your own beach towels, as linens are not to be removed from the Property. We keep a strict inventory of every towel, sheet, mattress pad, etc. Do not take them or ruin them with makeup or stains or you will be charged for replacement. 

POOL AND PROPERTY SAFETY 

The pool on the Property (if applicable) is private, there are no lifeguards on duty. The Renter assumes the responsibility that Renter and all guests will strictly observe all pool rules. The Renter understands and assumes the risk that failure to abide by safety rules is a breach of this Agreement and can cause serious injury or death and holds Company and Property Owner harmless. 

HURRICANES AND OTHER WEATHER EVENTS 

Especially during the months of June through November, the Panhandle of Florida is subject to tropical weather. Southern Coast highly suggests purchasing travel insurance through a third party, as we cannot offer refunds due to poor weather conditions, including but not limited to thunderstorms, tropical depressions, tropical storms, and hurricanes.

ENTRY BY COMPANY

Company may enter the Property at any time for any reason. Common reasons for company entrance can include but are not limited to: in case of emergency, to make any necessary repairs and/or if there have been complaints. Company will attempt to notify renter of Company’s intent to enter at least two hours in advance except in case of emergency or complaint. 

PROPERTY SUBSTITUTION 

On occasion a Property may not be available for rental during the dates of your reservation. This is usually due to ownership changes, properties being removed from rental use, or a need for extensive repairs or maintenance. In this unlikely event, Company reserves the right to substitute a comparable property. If comparable accommodations are not available, you will have the option of (1) selecting from other available properties (in which case you are responsible for, or will receive the benefit of, any difference in cost) or (2) receiving a complete refund of your reservation payment. In the event of a substitution of rental properties, all Terms in this Agreement, plus any Unit-Specific Terms specific to the substituted property, shall apply to your stay in the substituted property. 

LIMITATION OF LIABILITY 

To the maximum extent allowed by the law, Company is not liable for Renter’s property left behind or for any consequential, incidental, special, punitive, exemplary, or indirect damages from any cause whatsoever, regardless of whether they were foreseeable. Company’s maximum aggregate liability arising out of the rental of the Property to Renter is limited to the rental amount paid by Renter during the Rental Period. The Company is not undertaking to provide any security and is not responsible for any loss or theft of the Renter’s property. 

INDEMNIFICATION

The Renter agrees to indemnify and hold harmless Southern Coast and Owner, and their respective affiliates, for and from all claims for property damage, personal injury, illness or disease, or monetary loss resulting from your actions or omissions, and the actions or omissions of other Occupants, during or relating to your stay.

COMPLETE AGREEMENT

This Agreement contains the entire agreement between the parties and there are no other promises, terms or conditions, whether oral or written, other than contained herein. These Terms and Conditions may be modified only in writing signed by both parties. Checking the Terms and Conditions box required to book online confirms the Renter acknowledges that he/she has read and agrees to abide by these Terms and Conditions, however receipt of payment implies agreement of all terms and conditions. Company may change Terms and conditions without notice at any time.
